Over the last several decades, the IP law has become enforceable in China. Despite beliefs in other countries, Chinese investors are generally more concerned about IP issues than western startups.
Sadly, the majority of med device startups do not hire attorneys with specific experience in China IP. Please note US IP attorneys, even those born and raised in China yet only practicing in the US, are generally not considered attorneys with local China market practice experience.
Follow the normal course of the business and use common sense, get a good IP attorney. This rule of thumb applies to all countries, not just China.
